Terms of Service

Introduction

These Terms of Service ("Terms", "ToS", "Policy") are a legal agreement between WindowsGSM ("we", "us", "team") and you, the user. By using any of our Services ("Service", "Product"), like using our softwares or using our API, you agree that you have read, understood, and accepted to be bound by these Terms. If you under the age of majority in your jurisdiction, you need to have your legal guardian review and agree to these Terms in order to use our Service.

We reserve the right to update these Terms at any point in time, to add, modify or remove legal requirements. If the aforementioned changes affect your usage of WindowsGSM Products, we will notify you at least seven days prior to those changes taking effect. Unless stated otherwise, continuing to use the Service after modifications to the Terms will display your agreement and acceptance to those changes.

You may not impersonate WindowsGSM, the softwares or people associated with WindowsGSM. All assets and names are intellectual property of WindowsGSM and underlie Copyright.

WindowsGSM cannot be held responsible to any harm done to your computer. Use the software at your own risk and make sure to give minimal permissions in order to reduce potential risks.

Disclaimer of Warranty

THE SERVICES AND THE MATERIALS ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. IN ADDITION, WHILE THE TEAM ATTEMPTS TO PROVIDE A GOOD USER EXPERIENCE, WE CANNOT AND DO NOT REPRESENT OR WARRANT THAT THE SERVICES WILL ALWAYS BE SECURE OR ERROR-FREE OR THAT THE SERVICES WILL ALWAYS FUNCTION WITHOUT DELAYS, DISRUPTIONS, OR IMPERFECTIONS. THE FOREGOING DISCLAIMERS SHALL APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE TEAM BE LIABLE TO YOU OR TO ANY THIRD PERSON FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR OTHER INDIRECT DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICE OR OTHER MATERIALS ON, ACCESSED THROUGH OR DOWNLOADED FROM THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE TEAM HAS BEEN ADVISED OF THE POSSIBILITY OF THESE DAMAGES.
